Most people do not think about drawing up a prenuptial agreement unless they have a lot of money and assets. In the eyes of the law, it may not be a bad idea for most married people. A Prenuptial Agreement is a binding and legal agreement between two people that involve assets, liabilities and equity. The idea behind this agreement is define who brought what into the marriage and who gets what in the event of the end of the marriage.
For example, if a wife brings a 2011 Lexus into the marriage she wants to make sure she walks out with it and if a man has debt before the marriage the wife may also want to make sure she is not responsible for that debt when they divorce. Some of the benefits of having a prenuptial agreement are:
· Protecting your separate property
· Support your estate plan if you have one
· Define what property can be considered martial or community
· Reduce fighting and problems and if the marriage ends it can save you money
· Define the agreement between husband and wife
· Create procedures and ground rules for future matters
Even though legally it is a good idea to protect the man and wife but at the same time, some do think there are downsides to asking someone to sign it. The main two reasons are that a Prenup is not romantic and it may not be the right time. Signing a contract stating that share and share alike is not the romantic of an engagement. Some may take offense and others may not have thought it was a good idea but soon come to believe it is.
Not every marriage has a happily ever after and things that you cherish when you bring them into the marriage you may not leave with them. So overall a Prenuptial Agreement is not a bad idea. Talk to your lawyer before initiating a prenuptial agreement and talk to your future spouse about what they think. No matter how much in love you are, you always want to protect yourself and if kids are involved you want to protect them more.
