Child Support - Dallas TX

One very important aspect of any divorce proceeding is the children. They did not ask for a divorce and a divorce is going to cause them a lot of pain and emotional turmoil for a long time. It doesn't matter how mad or how much hate you have for your ex, the child custody, visitation and support should be worked out before you take it to a judge. Some exes when they are going through a divorce want an extreme amount of money for their support as well as for the kids. Support for the kids does not include money for you to live, it is for the care of the children.

There are some parents that choose to use a portion of the child support on themselves, but here are some uses that child support is intended for:

  • Child Support is to be used to provide Clothes, Shelter, Food and Education.
  • Child Support is to be used for the payment of medical services that your child may need.
  • Child Support may be used for Day Care or Babysitting
  • Child Support may be used to help pay for heat or water in the home, it should not be used to pay the cable bill. Or for your own cell phone bill.

The only people who should be benefiting from Child Support is the children. Of course if you use some support to pay the heat and water then others will benefit from that. In some states the non custodial parent may be responsible for the College costs of the child as well. Every state is different and the procedures are different too, the basics are often the same:

  • Each parent and their attorney must appear in front of the judge to file an application of support. The information that you will need to provide the court is different in each county, check with your attorney and be prepared for court.
  • Birth Certificates, Social Security Cards, Bank Statements and Tax Papers are often needed to determine how much support will be paid.
  • Each parent must provide a legal address where they are residing
  • If there is a case where one parent is denying parentage, a DNA test may be court ordered if you have not done so already.

A court will decide if you cannot agree on an amount and how often support will be made. Make sure that it is a number you can afford and a schedule you can stick to, otherwise you may find yourself back in court.
